Ladivelle Accents LLC ("we," "our," or "us") respects your privacy. This policy explains what personal information we collect when you visit ladivelleaccents.com or place an order, how we use it, who we share it with, and the rights you have over your information.

For the purposes of the EU/UK General Data Protection Regulation (GDPR), we are the data controller of personal information collected through this website.

2. Information we collect

  • Order details: name, email address, phone number, billing and shipping address, and order contents.
  • Communications: messages you send through the contact form, email, or phone.
  • Marketing preferences: your subscription status and communication preferences.

Information collected automatically

  • Device and usage data: IP address, browser type, pages viewed, referring URL, and time on site.

Information collected by our payment processors

When you make a payment, our payment processors (Stripe and Square) collect:

  • Your name, email address, billing address, and phone number.
  • Card details (card number, expiration date, and security code).
  • Transaction data — including declined or failed payment attempts, IP address, device fingerprint, and browser signals — used for fraud detection and prevention.

We never see or store your full card number. All card data is captured directly by Stripe or Square on their PCI-DSS-compliant infrastructure.

Incomplete checkout data

If you begin checkout but do not complete a purchase, our payment processors may still collect and retain the information you entered up to that point (such as your name, email address, and cart contents) for fraud prevention, abandoned-cart recovery, and to help you complete your order later.

3. How we use your information

  • To process and fulfill your order, including shipping and delivery.
  • To send order confirmations, receipts, shipping updates, and support replies.
  • To respond to your questions, feedback, or support requests.
  • To prevent fraud, unauthorized transactions, and abuse of our services.

  • To send marketing emails — only if you have opted in.

If you are in the EU or UK, we rely on the following legal bases:

  • Contract: to fulfill your order and provide customer support.
  • Legitimate interests: fraud prevention, securing our site, and improving our services.
  • Consent: marketing emails and non-essential cookies.
  • Legal obligation: tax, accounting, and consumer-protection laws.

5. Who we share your information with

We share information only with service providers who help us run our business, and only as necessary:

  • Shipping carriers (USPS, UPS, FedEx, or similar) — to deliver your order.
  • Email and hosting providers — to send transactional emails and operate the site.
  • Law enforcement or regulators — when required by law, subpoena, or to protect our rights and the safety of others.

We do not sell your personal information, and we do not share it with third parties for their own marketing purposes.

6. Data retention

We keep personal information only as long as needed for the purpose it was collected, or as required by law:

  • Order and transaction records: retained for at least 7 years to satisfy tax, accounting, and fraud-prevention requirements. This applies even if you later request deletion of your account or marketing preferences.
  • Contact form submissions: retained up to 2 years.
  • Marketing preferences: retained until you unsubscribe, plus a suppression record so we do not contact you again.
  • Website analytics: retained per our analytics provider's standard retention window.

Our payment processors retain transaction data under their own retention schedules as required for regulatory and fraud-prevention purposes. See Stripe's and Square's privacy policies for details.

7. International data transfers

We are based in the United States, and information collected through this site is processed in the US. If you are in the EU, UK, or another region with data-transfer restrictions, please note that our payment processors (Stripe and Square) may transfer data to and process it in the United States and India.

When required, transfers rely on Standard Contractual Clauses approved by the European Commission, or another lawful transfer mechanism. Stripe's and Square's compliance frameworks and Data Processing Addenda are available on their websites.

8. Cookies and tracking

We use a small number of cookies and browser-storage technologies to run the site and remember your preferences. This includes cookies set by Stripe and Square for fraud detection and payment autofill (Link). For the full list and how to manage them, see our Cookie Policy.

9. Your rights

Depending on where you live, you may have the right to:

  • Access the personal information we hold about you.
  • Correct inaccurate or incomplete information.
  • Delete your personal information, subject to our legal retention obligations.
  • Port your information to another provider in a machine-readable format.
  • Object to or restrict certain processing, including direct marketing.
  • Withdraw consent at any time for processing based on consent.
  • Opt out of marketing emails and any data sharing for advertising.
  • Lodge a complaint with your local data-protection authority (EU/UK) or your state attorney general (US).

10. Marketing and opt-out

We only send marketing emails to people who have opted in. You can unsubscribe at any time using the link in the footer of every email, or by emailing us directly. We will never add you to a marketing list simply because you started a checkout or made a purchase — transactional emails (order confirmations, shipping updates, receipts) are separate from marketing and are sent as part of fulfilling your order.

11. Security

We use industry-standard security measures, including TLS/HTTPS encryption for all traffic and access controls on our internal systems. Payment card data is processed exclusively by Stripe and Square on PCI-DSS Level 1 certified infrastructure. We do not store card numbers, expiration dates, or CVV codes on our servers.

12. Children's privacy

Our site and services are not directed to individuals under the age of 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, contact us and we will delete it promptly.

13. Changes to this policy

We may update this policy from time to time. When we do, we will change the "Last updated" date at the top of the page. Material changes will be communicated by email to customers with active orders or marketing subscriptions.
